La Historia Dogo Argentino Puppy Contract

This agreement is made and entered into on the date of Application Submission

by and between La Historia Dogo hereinafter called Breeder, and Buyer( as mentioned in the application). These terms and conditions are entered into and agreed upon by both the Breeder and the Buyer, who acknowledge the moral and legal worth of this contract.

AGREEMENT

 

The Deposit will be non-refundable, if you reserve a puppy who has already been whelped. Deposits will be held for a minimum of 1 year, if we are unable to provide you with a puppy from the current litter.

In consideration of the purchase price, the Breeder transfers all rights, privileges and responsibilities associated with the ownership of the above described Argentine Dogo puppy, with the following conditions subsequent.

___1. The puppy MUST be Spayed/Neutered between the ages of 16 and 18 months. If not spayed/neutered during this time ownership of the puppy immediately reverts back to the Breeder and the puppy must be returned at the Buyers expense (Family Companion Pet Puppies Only).

__2. The puppy must complete Basic Obedience Training by the age of 7 months. If this is not completed, the Breeder will have the puppy trained at the buyers expense.

__3. The puppy must have its ears cropped by the age of 12 weeks.  If this has not been done, the ears will stay natural permanently unless authorized by a veterinarian.

__4. The puppy will be entered in and compete in conformation events within reasonable driving distance, aprox.200 miles.(Co-owned Show Puppies)

 

GUARANTEES BY THE BREEDER

Congratulations on the purchase of your new Argentine Dogo. Everything possible has been done to ensure that your puppy gets the best start possible. The puppy has been started on its vaccinations series, has been checked for internal parasites and is healthy, BAER tested and shows no signs of bilateral deafness, microchipped and given lots of love and attention.  The Breeder guarantees that both parents of the puppy are free of dysplasia and will provide the Buyer with the health records of the puppy upon request after the completion of purchase.

 

The Argentine Dogo puppy is able to be registered through the FCPR, AKC (FSS) or DACA and the Breeder will provide you a Pedigree. The buyer is responsible for the registration fees and submission of all paperwork. (Pet quality puppies will only receive paperwork after spay/neuter receipt is shown.)

FOR SHOW POTENTIAL ONLY:

This Argentine Dogo is Show Potential as determined by the Original Standard. It is understood that this is being determined through the study of other dogs, and what characteristics are being displayed at the time of Buyers choice. If this Argentine Dogo achieves a title in conformation (Champion, Grand Champion, Supreme Grand Champion) the Breeder reserves the right to introduce this dog into their breeding program.  If the Dogo is not shown, then the breeder may evaluate him/her to determine whether or not they will be used in the breeding program

FOR SHOW AND PET PUPPIES:

Since the Argentine Dogo is relatively new to the United States, and not enough time has lapsed to eradicate all health problems there is only a guarantee against some genetic health problems limited to debilitating Hip Dysplasia* and Bilateral Deafness until the age of 24 months or the age of altering.       *as determined by our evaluation of a PennHip Certificate


This puppy has good temperament at the time of sale. The temperament of this Argentine Dogo puppy will be good as an adult if the Buyer properly socializes the puppy from this point on. Argentine Dogos Must have proper socialization, without it the temperament of this puppy could be negatively affected.

If for ANY reason during the lifetime of this Argentine Dogo, the Buyer is unhappy with or unable to keep it, the Breeder will take this puppy back immediately. Transportation and all related costs are the responsibility of the Buyer. NOTE: IF ANY REFUND IS GIVEN, IT WILL BE MINUS ALL BREEDER’S EXPENSES, including but not limited to getting vaccinations up to date, any veterinarian costs, and advertising to re-home. No dog is EVER sold on a "trial basis" and if a dog is frivolously bought and then returned, the buyer will be responsible to bear some of the financial burden or re-homing the dog.

GUARANTEES BY THE BUYER

___1. This puppy will receive the highest quality of care including food, water, shelter, active companionship, socialization, appropriate veterinary care, exercise, and love. This is to assure proper development and maintenance of the temperament, health, happiness, and well-being of the animal.

___2. This dog will NEVER be used for dog-fighting. If it is found that this dog was used for dog fighting, the Breeder’s reputation will be damaged; liquidated damages of $5000.00 will be owed immediately to the Breeder. Breeder’s reasonable attorney fees for recovery of the Dogo or the collection of the liquidated damages will be paid by the Buyer. Additionally, the buyer’s rights and ownership of the dog will immediately terminate and revert back to the Breeder who may immediately assume possession of the dog.

___3. This dog is NOT to be sold or given to an individual, a research facility, a shelter or humane society, or turned over to a rescue organization. If the Dogo is no longer wanted, the Breeder will take the dog back.  If the dog is not delivered back to the breeder this will damage the breeders reputation.  Liquidated damages of $5000 will be owed immediately to the breeder.

___4. Buyer agrees to notify the Breeder Immediately if at any time this Argentine Dogo is lost or stolen, and to make every effort to locate this Argentine Dogo. If not this will damage the breeders reputation.  Liquidated damages of $5000 will be owed immediately to the breeder.

___5. For Pet Puppies Only: This Argentine Dogo is sold as a pet; therefore, it is being placed on limited registration. Buyer understands that this means the buyer cannot show this puppy in conformation shows and buyer cannot breed this puppy. The puppy must be spayed/neutered between 16 and 18 months of age. If the dog is fixed earlier than this timeframe, the health of the Dogo will be compromised resulting in the tainting of the breeders reputation.  Liquidated damages of $5000 will be owed immediately to the breeder.

___6. For Show Potential Bitches Only: This puppy will not be bred until she reaches at least 20 months of age. Buyer agrees to breed only to registered male Argentine Dogos of quality, as determined by the Breeder. Buyer agrees that all pet quality puppies out of this bitch will be sold with limited registration along with a spay/neuter contract. No puppies out of this bitch will be sold to pet stores, puppy mills, commercial breeders, or any type of resale operation. If it is found that the bitch was bred before she reached 20 months of age, or if pet puppies are found being disposed of through pet stores, puppy mills, commercial breeders, or resale operations, or if pet quality puppies are being sold with full registration without spay/neuter agreements, the Breeder’s reputation will be damaged; liquidated damages of $5000.00 per puppy will be owed immediately to the Breeder. Breeder’s reasonable attorney fees for recovery of the Dogo or the collection of the liquidated damages will be paid by the Buyer. Additionally, the buyer’s rights and ownership of the dog will immediately terminate and revert back to the Breeder who may immediately assume possession of the dog. All females will be Co-owned by La Historia Dogos.

___7. For Show Potential Males: This puppy will not be bred until he reaches at least 18 months of age. He will only be bred to registered female Argentine Dogos of quality, as determined by the Breeder, who are owned by those approved by the Breeder. The owners of the bitches must agree to place all "pets" resulting from litters sired by this dog on limited registration and with spay/neuter agreements. If pet puppies are found being disposed of through pet stores, puppy mills, commercial breeders, or resale operations, or if pet quality puppies are being sold with full registration without spay/neuter agreements, the Breeder’s reputation will be damaged; liquidated damages of $5000.00 per puppy will be owed immediately to the Breeder. Breeder’s reasonable attorney fees for recovery of the Dogo or the collection of the liquidated damages will be paid by the Buyer. Additionally, the buyer’s rights and ownership of the dog will immediately terminate and revert back to the Breeder who may immediately assume possession of the dog. All males will be Co-owned by La Historia Dogos.

___8. The Buyer acknowledges and agrees that other dominant breeds of dogs may not be compatible living companions for your Argentine Dogo for reasons of dominance, aggression, or sex. The buyer must give full disclosure to the breeder as to any other dog(s) in his/her ownership or possession at the time of this sale, so that their compatibility with this dog and/or adequacy of the buyers facilities for the purposes of ensuring the safety and well-being of this dog can be assessed by the breeder before the final sale takes place, for these are important factors in the breeders decision to sell the dog to the buyer, and the buyer hereby states that he/she has indeed provided full disclosure of this information to the breeder, if, after the date of this contract, the breeder discovers that the buyer has not been honest about their other pets, the breeder may require the buyer fulfill certain actions that will ensure the future safety and well-being of the dog, and the buyer will be responsible for the cost of such, or the breeder may demand the return of the dog from the buyer to the breeder without any compensation to the buyer.

___9. The Buyer acknowledges and agrees that the breeder has fully explained to him/her the naturally occurring dog-aggressive characteristics, the dominant nature of the Dogo, and the possibility for the Dogo to do great harm, and the buyer fully understands them; that the breeder has stressed the need for, and recommended the undertaking of proper socialization and professional training of the Dogo in this regard, and that the breeder is in no way responsible for or to be held accountable for any future occurrences relating to this Dogo owned by the buyer.

___10. The Buyer agrees to send five photos a month to the breeder of the following poses Front, left side, right side, rear, and headshot until the dog is 18 months, then every 6 months until the age of 4 years. After that one per year will be good, any pose will do.  If at anytime the photos are not submitted, we will be unable to know the welfare of the Dogo, therefore the health guarantee will be void.

___11. The Buyer agrees that this contract will be bound by the laws of the State of New York, and that any dispute regarding this contract, or the Dogo, will be settled in a New York court.

___12. The Buyer agrees to notify the breeder if any location change is necessary for the dog.  If this is not not upheld the breeder can no longer know that the health and well being of the dog is being maintained.

___13. The Buyer agrees to notify the breeder if there is any serious illnesses/injury that requires the dog undergo surgery or prolonged medical attention.

Any breech of this contract is a potential to damage the reputation of the breeder, this damage will be liquidated to $5000. due at the time of breech.
